On the problem of discovering and collecting archaeological objects
Abstract. The article discusses the issues of liability for transactions with archaeological objects. It is concluded that, in general, alienation of archaeological objects by individuals is permitted, provided that the objects have been included in the Museum Fund of the Russian Federation. At the same time, the question of the risks associated with the seizure of archaeological objects not included in the Museum Fund, provided by individuals for exhibitions in museums, remains open. The article also analyzes the correctness of using the category «archaeological find» taking into account the concept of «find» used in the Civil Code of the Russian Federation.
