International and foreign models for the preservation of immovable cultural heritage: a comparative legal and cultural analysis

Abstract. The article examines how foreign legal systems address the same practical problem: how to preserve the historical value of an immovable heritage property without excluding it from contemporary life. The study draws on international instruments and the legislation of France, Italy, Germany, England, Australia, and the United States. The comparison is based not on formal affiliation with a particular legal tradition, but on specific mechanisms: the distribution of powers, the legal position of property owners, procedures for approving works, community participation, and forms of financial support. The analysis shows that sustainable conservation systems are not built around a single instrument. Administrative control is effective only when combined with professional expertise, realistic obligations for owners, and economic incentives. Three analytical models are proposed to describe these combinations: protective-normative, adaptive-regulatory, and integrative. Distinguishing between them makes it possible to assess foreign experience more accurately and to avoid transferring individual legal rules outside the institutional conditions in which they operate.
