Formation and development of copyright in China:
from doctrine to instruments of state cultural policy
Abstract. The article presents a comprehensive analysis of the copyright of the People's Republic of China as a unique legal, cultural, political and ideological phenomenon. The relevance of the research is due to the need to understand the rapid evolution of the Chinese intellectual property system from a country with minimal legal protection to one of the world leaders in the field of digital content and technological innovations. The work is particularly important in the context of the deepening strategic partnership between Russia and China, as well as in connection with the need to adapt legislation to the challenges of the digital age, including the regulation of artificial intelligence, big data and Internet platforms.
The purpose of the study is to identify specific principles, institutional mechanisms and trends in the development of Chinese copyright, as well as to assess the effectiveness of this model in the context of digital transformation. The methodological basis consists of historical-legal, comparative-legal, formal-legal methods.
The work traces the genesis of copyright in China: from traditional Confucian ideas about collective knowledge and the practice of copying as a form of respect, through the Soviet model of state regulation of creativity, to modern legislation, which is being formed under the influence of external economic pressure and internal needs of innovative development. Special attention is paid to the analysis of the current version of the Copyright Act (2020), including the open list of protected objects, the specifics of the legal regime of official works and the implementation of the concept of «fair use».
The author examines in detail the institutional structure of copyright protection, in particular, the «tripartite mechanism», which combines administrative, judicial and conciliatory forms of protection. The article reveals the system-forming role of the Chinese Communist Party in strategic planning, ideological control and ensuring uniformity of law enforcement practice. A separate section is devoted to adapting Chinese legislation to the challenges of digitalization: the introduction of the «notice-delete» system, the duty of platforms to exercise «due diligence», as well as the first steps in the legal regulation of works created using artificial intelligence systems.
Based on the analysis, a conclusion is drawn about the formation of a unique hybrid model of copyright, in which Western legal structures are filled with Chinese political and economic content, serving the strategic objectives of technological sovereignty, cultural security and ideological control.
